To ensure our collaboration runs smoothly and transparently, these General Terms and Conditions apply to all products and services provided by Positive by Nature, both online and offline.

1. Definitions

• Positive by Nature: The business offering training, workshops, moderating services, keynote speaking, and online products or services.
• Client: Any natural or legal person purchasing or using the services of Positive by Nature.
• Participant: The individual who takes part in a training, workshop, or other activity.
• Offline products and services: All training sessions, workshops, moderating and keynote services delivered in person.
• Online products and services: All products purchased through the Positive by Nature online academy and/or webshop at positivebynature.nl or www.positivebynature.com

2. Applicability

• These Terms and Conditions apply to all offers, quotations, services, products, and agreements provided by Positive by Nature, unless otherwise agreed in writing. By purchasing or using any product or service, the client agrees to these Terms and Conditions.

3. Payment Terms

• Offline products and services:Payment is made by invoice based on the approved quotation. Upon receipt of the signed quotation, the assignment begins and the cancellation policy takes effect. Invoices for moderating, keynote, or in-company sessions are sent within one week after delivery and must be paid within 14 days.
• Online products and services: Payment is made immediately through a secure online payment method (bank or credit card). Access to digital content is granted immediately after payment unless stated otherwise.

4. Right of Withdrawal (Online Products)

• In accordance with EU consumer law, buyers of online digital products have the right to withdraw from their purchase within 14 days, provided that access to the digital content has not yet been activated. Once the digital product or training has been accessed or downloaded, the right of withdrawal expires. To exercise the right of withdrawal, clients can contact info@positivebynature.nl within 14 days of purchase.

5. Cancellation Policy (Offline Services)

• Rescheduling in-person sessions (moderating, keynote, or in-company training) is free up to two months before the scheduled date. After that, fees apply: 20% within two months, 40% within one month, and 60% within two weeks. Cancellations less than two weeks before the agreed date are charged at 100% of the agreed fee.
• Positive by Nature reserves the right to cancel sessions in case of insufficient participants or due to illness or unforeseen circumstances. In such cases, any payments will be fully refunded.

6. Access and Use

• Access to online courses is personal and non-transferable. Login credentials must be kept confidential. Training materials may be used for personal purposes only and may not be copied, shared, or distributed without written consent from Positive by Nature.

7. Responsibilities

• Positive by Nature will carry out assignments with care and professionalism. Communication is primarily via email, with responses typically within 48 hours, excluding weekends, holidays, and unforeseen circumstances.
• Clients are responsible for providing accurate and timely information relevant to the service or event.

8. Liability

• Participants in mindfulness-based training acknowledge the potential physical and emotional effects of such exercises. Participation is voluntary. Positive by Nature is not liable for any physical or psychological injury, nor for loss or theft of personal belongings during in-person sessions.

• Liability is limited to the total amount invoiced for the relevant service or product.

9. Complaints and Disputes

• If you are dissatisfied with a service, please contact Positive by Nature as soon as possible. Formal complaints may be submitted via email to info@positivebynature.nl within 14 days after the activity. Complaints will be handled confidentially and responded to within four weeks.
• Dutch law applies exclusively. Disputes will be submitted to the competent court in the Netherlands.

10. Intellectual Property

• All intellectual property rights for online and offline materials belong to Harriët van der Weele, founder of Positive by Nature. Materials may not be copied, shared, or used commercially without prior written consent. Recording audio or video of training sessions is only allowed with prior written approval.

11. Privacy & Data Protection

• Positive by Nature respects your privacy and processes personal data in accordance with the EU General Data Protection Regulation (GDPR). Personal data will only be used for communication related to your purchase or participation and will never be shared with third parties without consent.

12. Changes to the General Terms and Conditions

• Positive by Nature reserves the right to amend these Terms and Conditions. The latest version will always be available on the website.
